Transfer impact assessment (TIA)

A transfer impact assessment is the documented analysis of whether a third country’s laws and practices — particularly government access to data — undermine the protection promised by standard contractual clauses or other transfer tools. Required in substance by the Schrems II judgment, it examines the transfer, the destination’s legal regime, and any supplementary measures such as encryption where keys stay in the EU.
